Contract Guidance for Facilities with Approved Tracking Attestations on File

Green-e® Energy Participants may wish to contract with facilities that have active Tracking Attestations on file with Center for Resource Solutions. Such generating facilities have submitted an online Tracking Attestation form to CRS, which has reviewed the submitted generator information and approved the tracking attestation for a period of up to three years. Generating facilities with active Tracking Attestations on file with CRS are considered “CRS Listed” facilities.

For convenience, CRS is providing sample contract language for Participants to consider when entering into such transactions. Please note that CRS is not providing legal advice and encourages Participants to work with their own legal counsel to develop language appropriate for their needs. Nothing here supplements or modifies the requirements of Green-e® Energy certification, which are established by the terms of a Participant’s certification agreement.

Green-e® Energy Participants wishing to sell or procure products from CRS Listed generators may consider using contract language along the following lines:

“During the Term of this Agreement, Seller shall maintain an active Tracking Attestation Form with the Center for Resource Solutions for any of Seller’s generating facilities to which this Agreement applies.”

Please note that acceptance by CRS of a Tracking Attestation does not equate to Green-e® certification and does not ensure that Participants who use such generation to substantiate certified sales will pass the annual verification audit without issue. There are additional certification requirements checked during the annual verification process that are not screened during the Tracking Attestation review.

Please also note that generators that are CRS Listed are not permitted to use any CRS trademarks or logos, including the word mark “Green-e” and such generators are prohibited from using the terms “Green-e® eligible” or “Green-e® certifiable.” They should instead describe their generating facilities as “CRS Listed” or “facilities with Approved Tracking Attestations on file with CRS”. Generating facilities that use without permission any CRS trademarks, including without limitation its certification marks like the word mark “Green-e” will be removed from the list and have their Tracking Attestation terminated. CRS reserves the right to take any and all other enforcement action.

Participants involved in transactions for supply from generating facilities that do not have an active Tracking Attestation on file that wish to maximize the likelihood that such supply can be used successfully toward their certification requirements can contact CRS to discuss this circumstance.
